Pink, OK (May 27, 2019) – On May 23, around 2:38 a.m., Oklahoma Highway Patrol responded to the scene of a motorcycle accident on SH-9, just west of Patterson Road.
According to reports, 33-year-old Auston Colley was traveling east along SH 9 on a 2009 Harley Davidson when his motorcycle struck a horse crossing the highway. Colley was ejected from his motorcycle and came to rest approximately 90-feet east of the point of impact. The motorcycle continued approximately 227-feet down the roadway before stopping.
Colley was transported by REACT EMS to OU Medical Hospital in Oklahoma City for treatment to injuries sustained in the collision.
OHP concluded the animal in the roadway was the cause of the incident.
Our thoughts and prayers are with Mr. Auston Colley and his family at this time.
Motor vehicle accidents can occur for a wide variety of reasons, especially here in Oklahoma. Unfortunately, there are many instances where animals in the roadways cause injuries to unsuspecting drivers. This is especially true when drivers are on motorcycles.
There have been conflicting views surrounding liability for the owners of horses involved in motor vehicle accidents. Thankfully, in 1995, the state of Oklahoma recognized that horses running freely in the roadway occurs due to the negligence of their owners (Kelley v. Barnett, 897 P.2d 289 (1995)). This case set precedence for all future cases.
If you were injured in a motorcycle accident caused by an animal running in the roadway, you may be entitled to compensation to help alleviate some of the losses you experienced from your accident. These losses often include lost wages due to recovery, medical expenses, property damage or loss, and other burdens sustained from the incident.
