DePuy Case – Multidistrict Litigation (MDL) and What it Means for You

The DePuy lawsuit has resulted in over a hundred Americans already filing a lawsuit in federal courts.  Many more are expected to file this year as there are an estimated 11,500 people that could be impacted by this faulty prosthetic.  These numbers could further rise as doctors continue to run tests to establish the proper working of the DePuy metal hip implants in patients across America.

To qualify as a potential plaintiff for this case, you or a loved one must have had hip replacement surgery only after July 2003 as that was when the ASRTM Acetabular System was first made available.

In December 2010, an order was issued that all DePuy cases must be consolidated and centralized in a Multidistrict Litigation (MDL).  This means that unlike a class action lawsuit where one person sues on behalf of all the persons making claims, these cases will maintain their individuality.  Therefore, damages will be settled individually to each plaintiff based on how successfully their claims are established.

If you or a loved one has received a recall notice, you must ensure that you act within a specified time frame.  The litigation process can be a lengthy ordeal during which time you are responsible for your medical expenses.  Legally, there are many types of damages that could be compensated.  These include lost wages, suffering and pain, long-term disability and medical and related expenses to restore you to your original physical and mental state.  While the company has agreed to compensate affected parties for damage caused, the above mentioned expenses have not been included thus far.

The DePuy lawsuit is a little unique in the sense that the degree that one has been affected could vary greatly from the other.
